Right of Withdrawal for Consumers
Consumers generally have a statutory right to withdraw from a distance contract within fourteen (14) days. However, this right of withdrawal does not apply to digital content under § 356 (5) of the German Civil Code (BGB) if the following conditions are met.
Notice on the Expiry of the Right of Withdrawal for Digital Content
The right of withdrawal expires prematurely if:
- the seller has begun to perform the contract after
- the consumer has expressly consented to the start of the contract execution before the end of the withdrawal period, and
- the consumer has acknowledged that, by giving consent, they lose their right of withdrawal once the contract has begun.
